SRZ represented half of the board of trustees of the ILGWU Local 102 Retirement Fund in a deadlock arbitration over whether to merge the fund into the UNITE HERE National Retirement Fund. As a result of SRZ’s efforts, the arbitrator agreed that the merger was in the best interest of the local fund’s participants and beneficiaries.

In another matter, SRZ prevailed in a highly contentious withdrawal liability arbitration. The arbitrator found the company liable for withdrawing from a pension fund prior to the fund’s merger, and also liable for withdrawing from the merged fund, SRZ’s client. Significantly, the arbitrator disregarded the company’s reliance on signed documents, including a collective bargaining agreement, after we demonstrated that the signatures on those documents were fraudulent.
