The Bankruptcy Code's Automatic Stay

Section 362(a) of the Bankruptcy Code contains a broad statutory stay of litigation and lien enforcement, effective automatically on the commencement of a bankruptcy case. This automatic stay gives a trustee or Chapter 11 debtor-in-possession a breathing spell from creditors by stopping all collection efforts, harassment, and all foreclosure actions, allowing a debtor to attempt a reorganization plan.
