The Bankruptcy Code's Automatic Stay
January 2008
Practising Law Institute
Section 362(a) of the Bankruptcy Code contains a broad statutory stay of litigation and lien enforcement, effective automatically on the commencement of a bankruptcy case. This automatic stay gives a trustee or Chapter 11 debtor-in-possession a breathing spell from creditors by stopping all collection efforts, harassment, and all foreclosure actions, allowing a debtor to attempt a reorganization plan. This 40-page treatise covers everything you need to know about automatic stays, including chapters on Scope and Duration of Stay, Acts Stayed, Exceptions to the Stay, Enforcement of the Stay and Obtaining Relief from Stay.
