DOL Releases Guidance on Form LM-10

We have previously alerted you to federal law requirements for employers that engage in certain financial transactions or arrangements with unions, union representatives, union trustees of Taft-Hartley benefit funds, or labor relations consultants to disclose such transactions or arrangements to the U.S. Department of Labor ("DOL") on Form LM-10. (Please see our previous Alerts regarding Form LM-10 requirements for Taft Hartley Funds  and Taft Hartley Fund and Service Providers .) After much anticipation, the DOL has released new guidance effective for fiscal years commencing on or after January 1, 2005, which clarifies Form LM-10 reporting requirements. We highlight below the key elements of the DOL's new guidance.
