District Court Hands SRZ Client Quigley Company a Quick Win

United States District Judge Colleen McMahon handed SRZ client Quigley Company, Inc. a quick win on February 26, 2009, when she denied the motion of a dissident group of asbestos claimants to have a district judge "concurrently preside over" the hearing on confirmation of Quigley's reorganization plan. According to the dissident group, a district judge was required to conduct the plan confirmation hearing concurrently with a bankruptcy judge because of the complex legal and fact issues being litigated.
Quigley opposed the motion, describing how the issue had been previously litigated and resolved by the parties in open court. In District Judge McMahon's words, the issues raised by the dissident group "do not now warrant a re-airing." She summarily denied the motion prior to receiving a response from the dissident group, explicitly relying on "the reasons set forth in Quigley's opposing papers."
