Choice of Law Can Be the Key to an Insurance Case

In many insurance cases, a decision as to which state’s law governs the controversy will also effectively resolve key issues in dispute.
For example, if New York law applies to a dispute, the insurance carrier will be able to strictly enforce notice of claim requirements. On the other hand, if New Jersey law applies, the insurer will not be able to deny a claim on late notice grounds unless the late notice has prejudiced the insurer.
