Arbitration has long been heralded in the United States as a lower cost, more efficient means to adjudicate disputes and a welcome alternative to the often over-crowded court system. Consequently, a sophisticated system of commercial arbitration has developed through the use of such organizations as the American Arbitration Association and the International Institute for Conflict Prevention and Resolution. In addition, securities and commodities exchanges such as the New York Stock Exchange (the "NYSE") and the National Association of Securities Dealers (the "NASD") also employ arbitration to resolve claims by investors and employees, and collective bargaining agreements often mandate arbitration as the sole means of adjudication of disputes arising under them.
