Questions and Answers About Cancer in the Workplace and the ADA

The U.S. Equal Employment Opportunity Commission ("EEOC") periodically issues guidance to employers regarding their obligations under the anti-discrimination statutes within the EEOC's purview.  Although such guidance is not binding law, it articulates the position of the agency, and may be relied upon by the courts that adjudicate employment discrimination disputes.  In its "Questions and Answers Series”, the EEOC has issued guidance regarding employer obligations under the Americans with Disabilities Act ("ADA") with respect to job applicants and employees who have cancer.  We enclose a copy of the guidance.  Other guidance in the series is available for epilepsy, diabetes and intellectual disabilities.  (See www.eeoc.gov.)
