The Chief Bankruptcy Judge of the Southern District of New York handed SRZ client Quigley Company Inc. an important win when he approved the furnace-lining manufacturer’s reorganization plan disclosure statement over fierce opposition, freeing it to solicit acceptances of the plan. A dissident group comprising asbestos claimants and the U.S. trustee had argued that claimants who had settled unrelated direct claims against Quigley parent Pfizer Inc. should have been classified separately from those who had not, reasoning that the two groups received unequal treatment under Quigley’s plan. The court found that Quigley’s classification scheme and treatment of the members of the claimant class satisfied the Bankruptcy Code, and that its disclosure statement contained adequate information and did “not describe a plan that is unconfirmable as a matter of law.”
