SRZ Partner David Karp Contributes to Distressed Debt Investing Blog

SRZ partner David J. Karp is a regular contributor to the Distressed Debt Investing blog. His first post for the blog, “Prospecting for European Distressed Loans,” discusses issues in buying and selling European distressed loans. David is also authoring a three-part series for the blog that highlights the impact recent distressed debt cases may have on distressed debt traders and explains how certain disputes may have been prevented through better pre-trade diligence and planning. The first post in the series, “Advanced Distressed Debt Lesson: Trade Dispute Litigation: What Distressed Investors Need to Know,” highlights a dispute between a trade vendor and a bankruptcy claims buyer over when the buyer’s put right, triggered by a potential impairment of the purchased claim, becomes enforceable. The second post, “Advanced Distressed Debt Trading & Trade Dispute Litigation: Debtor vs. Secondary Market Claims Purchaser,” discusses the risk of impairment in the context of a dispute between a debtor’s liquidating trustee and a claims purchaser. In the third post, David will explain new Fifth Circuit case law clarifying the binding nature of oral agreements for bank debt trades in a manner consistent with the courts of England and Wales.
