In a recent Bloomberg article by Frances Schwartzkopff and Tasneem Hanfi Brogger, Schulte Roth & Zabel partner Anna Maleva-Otto discussed concerns regarding ambiguous rules for EU ESG fund designations.
Anna explained that ESG continues to be an evolving area of regulation in Europe. As a result, some hedge fund managers and private equity firms worry about future changes to the rules, and may decide to avoid the EU SFDR fund designations for their funds altogether. She said, "US managers in particular – because the United States tends to be such a litigious jurisdiction – are concerned about future investor claims for misselling.”
