SRZ Partner Benjamin Kozinn Quoted in Private Equity Law Report: “SEC Proposed Private Fund Rules: General Observations (Part Three of Three)"

In a recent Private Equity Law Report article by Robin L. Barton, Schulte Roth & Zabel partner Benjamin Kozinn shares his thoughts regarding the SEC’s newly proposed rules regarding private funds.

In regards to perhaps the most controversial rule in the SEC's proposal, which would limit private fund advisor's ability to provide certain preferential terms, Kozinn said “[y]ou’re juxtaposing the obligation of the investors’ fiduciaries to get the best deal against having fund terms that make sense for the manager and its business in a way that starts becoming untenable. You end up with a race to the bottom in terms of liquidity, fees, etc.”
