SRZ Partner Martin Schmelkin Quoted in Regulatory Compliance Watch: “FTC Attacks Noncompete Agreements”

In a recent Regulatory Compliance Watch article by Bill Myers, Schulte Roth & Zabel partner Martin Schmelkin discussed the FTC's recently proposed rules which would ban non-compete agreements.
While Marty "[doesn't] think the agency believes the proposal's going to remain in its current form," he believes that the FTC feels "noncompete clauses should be more the exception than the rule."
Marty cautions employers that they should "think defensively" and use this as an opportunity to review their noncompete/nondisclosure policies, determining if they are necessary, reasonable and unlikely to impose undue hardship on employees.
