On March 25, 2021, the Alternative Reference Rates Committee (“ARRC”) released supplemental versions of its recommended hardwired fallback language for U.S. dollar LIBOR denominated syndicated and bilateral business loans, which incorporate the certainty on fallback timing and economics derived from the recent March 5, 2021 announcements by the ICE Benchmark Administration and the Financial Conduct Authority announcing the final cessation dates for all LIBOR settings. These supplemental recommendations offer simplified versions of the original June 30, 2020 recommended fallback language for syndicated business loans and the Aug. 27, 2020 recommended fallback language for bilateral business loans. The ARRC notes that market participants may use either the original 2020 language or the new simplified 2021 language as both will lead to the same outcome at transition.
