The Alternative Reference Rates Committee (“ARRC”) has requested no-action relief from the Division of Swap Dealer and Intermediary Oversight of the U.S. Commodity Futures Trading Commission (“CFTC”) under the Commodity Exchange Act and related CFTC regulations regarding the treatment of swaps that are amended for the transition to reference risk-free rates (“RFRs”) due to the upcoming cessation of LIBOR and other inter-bank offered rates (together, “IBORs”).

The CFTC previously granted relief from certain swap regulations where a swap is amended for purposes of IBOR transition. The ARRC requests that relief be expanded to include the exchange of voluntary compensation for swaptions, or amendment of a swaption’s terms, by counterparties in response to IBOR transition-related discounting changes made by derivatives clearing organizations (“DCOs”). In addition, the ARRC requests that changes to credit support annexes, where counterparties seek to align the interest rates with the discount rate changes implemented by the DCO, also not be deemed to trigger the regulatory requirements.
