MiFID II: Final FCA Rules Published

In July 2017, the Financial Conduct Authority published its second policy statement on the U.K. implementation of the revised Markets in Financial Instruments Directive (MiFID II), setting out the final rules and guidance on conduct of business, client assets and certain other matters. In this article, partners Christopher Hilditch and Anna Maleva-Otto outline key components of the policy statement, including the administration of research payment accounts, best execution requirements, telephone taping and client categorization.

The US Securities and Exchange Commission (“SEC”) and the Commodity Futures Trading Commission (“CFTC”) have overhauled Form PF and private fund managers have until March 12, 2025, to begin reporting on the new Form. The changes to the reporting requirements mandated by the amendments to the Form (“Form PF Amendments”) will require substantial preparation by many managers.[1]
