SRZ Attorneys Author Two-Part Series on Enforcement Actions Against Compliance Officers

SRZ attorneys Betty Santangelo, Gary Stein and Melissa G.R. Goldstein and former SRZ attorneys Jennifer M. Opheim and Seetha Ramachandran authored a two-part article for The Banking Law Journal on enforcement actions against compliance officers. In Part I, the authors discuss a first-of-its-kind $1-million FinCEN assessment against the former chief compliance officer of MoneyGram International Inc. In Part II, the authors continue their discussion of the MoneyGram action and also discuss Bank Leumi’s consent order with the New York State Department of Financial Services, under which the bank admitted engaging in an illegal cross-border scheme to assist U.S. clients in evading federal and state taxes.

The US Securities and Exchange Commission (“SEC”) and the Commodity Futures Trading Commission (“CFTC”) have overhauled Form PF and private fund managers have until March 12, 2025, to begin reporting on the new Form. The changes to the reporting requirements mandated by the amendments to the Form (“Form PF Amendments”) will require substantial preparation by many managers.[1]
