SRZ Business Reorganization Attorneys Produce Series on ABI Commission Report

On Dec. 8, 2014, the American Bankruptcy Institute Commission to Study the Reform of Chapter 11 issued a 400-page report recommending changes to Chapter 11 of the Bankruptcy Code. The report is the result of a two-year effort by 150 practitioner-ABI members. SRZ business reorganization attorneys continue to analyze the recommendations contained in the ABI report through a series of SRZ Client Alerts. Each Alert evaluates significant proposed changes that, if enacted, would represent a drastic departure from what are today considered fundamental principles of bankruptcy law.

The US Securities and Exchange Commission (“SEC”) and the Commodity Futures Trading Commission (“CFTC”) have overhauled Form PF and private fund managers have until March 12, 2025, to begin reporting on the new Form. The changes to the reporting requirements mandated by the amendments to the Form (“Form PF Amendments”) will require substantial preparation by many managers.[1]
